FILING A DECLARATORY JUDGMENT

Clerks are unable to assist you in completing the accompanying form. This form is provided as
an example, it is recommended that you retype the form adding your information so that it is
legible to the Department of Revenue.

A judgment will be completed by the Department of Revenue based upon the information on the
petition. If the petition is incorrect the judgment will be incorrect or denied.

Please double check the petition includes the correct make, model, year, and VIN number and
the valuable consideration the property was acquired.

The petition MUST be signed in front of a notary before filing.

The filing fee $38.50 and certified mailing fee $10.00 total $48.50. Please bring this total
payment form in cash, check, money order or credit/debit card. There is a $2 processing fee with
the use of a card.

After submitting the petition, a copy will be sent to the Department of Revenue via certified mail
for service. OR you may choose to have it served by the Sheriff’s Department in Cole County.
If you choose this option the filing fee will be $38.50 and we will need a money order to Cole
County and you will need to call Cole County to obtain the correct payment amount.

The DOR will send answers to the court and to you at the address you provided on the filing
information sheet.

If/When a judgment is signed by the judge, a certified copy will be sent to you at the address
provided. You may then take the certified copy of your judgment to the license bureau to obtain
a new title.

You may ‘track your case’ by visiting www.courts.mo.gov and clicking case.net and searching
for your case. Once found click the ‘track my case’ option and follow instructions.

If a hearing is scheduled, you will be notified in writing to the address provided.
