TANEY COUNTY BOARD OF ADJUSTMENT
WEDNESDAY October, 18 2023, 6:00 P.M.
COUNTY COMMISSION HEARING ROOM
TANEY COUNTY COURT HOUSE
Call to Order
The Board of Adjustment held a meeting on October, 18 2023 at 6:00 p.m. located at the Taney
County Courthouse in the County Commission Hearing Room at 132 David Street, Forsyth,
Missouri. Vice Chairman David Herd called the meeting to order at 6:00 p.m. Scott Starrett
established a quorum and an explanation of public hearing procedures, presentation of exhibits
and governing statutes.

Also present was Planning and Zoning Administrator, Scott Starrett and Zoning Coordinator,
Presley Cozort.
Review and Action
Mr. Roebuck moved to approve both August 16, 2023 and September 20, 2023 Regular Meeting
Minutes. Mr. Caudill seconded the motion. The motion passed by vote: 4 (aye), 0 (nay) and 1
(abstain).
Mr. Herd swore in everyone who signed up to speak.
Public Hearings
#23-006V: Representative Karen Lacy was present for the applicant. No one was present to
speak for or against the application. Mr. Persinger moved to approve the eighteen foot variance
request as presented with stipulations that the carport has no siding, no concrete foundation and
the applicant check for any easement setback requirements with White River Electric. Mr.
Caudill seconded the motion. The motion passed by vote: 5 (aye) and 0 (nay).
#23-003A: Representative Brandon Weber was present for the applicant. Nathan Jaeger was
present to speak for the application. Tucker Virnig was present to speak against the application.
Mr. Roebuck moved to deny the appeal based on no error in law was made by the Planning
Commission. Mr. Caudill seconded the motion. The motion passed by vote: 5 (aye) and 0 (nay).
#23-004A: Applicant James Wurster was present. Jim Crossen was present to speak for the
application. Beth Wyman, Holly Wilson, Janene Cross, Rocky Wyman, Cody Balisle and Darryl
Maass were present to speak against the application. Mr. Roebuck moved to deny the application
based on no error in law made by the Planning Commission. Mr. Persinger seconded the motion.
The motion passed by vote: 3 (aye) and 2 (nay).

Adjournment
Mr. Herd moved to adjourn the meeting at 8:35 p.m. Mr. Caudill seconded the motion. The
motion passed by vote: 5 (aye) and 0 (nay).
