ROAD PETITION STEPS
1. Read entire petition.
2. Petition must be completely filled out. Petition must include road name, section,
township, range and if possible please provide the legal description. You can find this
information at the Assessors' Mapping Department or on Beacon (taneycounty.org)
then go to departments, then go to assessor, you will then see GIS mapping, click on
GIS mapping and follow directions.
3. A map must be returned with the petition.
4. Notice of posting must be returned with petition.
5. County Road Affidavit must be filled out notarized.
6. Once Petition is completed in full and documents are attached please return to the
Taney County Road & Bridge Department. If any portions of the Petition are not filled
out correctly, the Petition will be returned to be completed.
7. There will be a $3.00 charge that needs to be taken to the Taney County Clerk's Office
per statute 51.410, to verify registered voters signatures.
Additional fees.
51.410. The county clerk shall charge a fee of three dollars for each certificate, bond,
filing, petition, license, order, recording, or other document, writing, or transaction
handled in accordance with the duties of the office of county clerk. The clerk shall pay
into the treasury of the county any and all fees collected under the provisions of this
section.

NEW ROAD ADOPTION POLICY
The Taney County Commission will consider the following items before taking any new
road into the county for maintenance.
l. Roads within Sub-divisions:
a. Development must be at least 60% built out or 4 years elapsed since the start of the
first house.
b. Right of Way must be at least 40 feet or residents willing to donate sufficient land to
meet the requirement.
c. Turn-Around must exist or land owners willing to donate the necessary land to build
one if not a through road.
2. Roads not within a Sub-division:
a. Traffic count must be at least 50 vehicles per week.
b. Must be three (3) or more permanently occupied dwellings on the road.
c. Right of Way must be at least 50 feet or the landowners willing to donate the
additional needed.
d. Turn-arounds, if not a through road of at least 80'diameter or hammer head
turnaround must exist or land owners willing to donate the necessary land to build
one.
3. Petitions:
a. Any road petition that has been taken before the County Commission and requires
additional information, right-of-way or turn-a-round etc. shall have ninety (90) days
to forward required documents to the County unless otherwise noted by the County
Commission. Should documentation not be handled within the specified timeline,
said petition will be denied and petitioner will have to re-submit.
All costs associated with verification and staking of right of way will be the responsibility
of the petitioner.
The above criteria is used to help the Commission make their decision, but it does not
imply that if the above conditions exist that any petitioned road meeting them will
automatically be taken in.

ROAD PETITIONS
New County Roads are Established, Changed or Relocated in accordance with the
Missouri Revised Statutes 228.101 through 228.190. Taney County offers the following
forms to assist you in the process of establishing a new road or requesting that an existing
road be taken into the county road system..
Procedure for establishing a County Road shall be as follows: Applications for the
establishment of all public roads, except state roads, shall be made by petition to the
County Commission. Such petition shall be signed by at least twelve registered voters of
the Municipal Township or Townships through which such proposed road may run, three
of whom shall be of the immediate neighborhood, and shall specify the proposed
beginning course and termination thereof, and shall be accompanied by the names of all
persons owning land through which such road shall run, with the amount of damages, if
any, claimed by them, so far as can be ascertained, and also the names of those who are
willing to give the right-of-way for such proposed road, except that if the proposed road
begins or terminates on, or runs along a boundary between the county wherein such
petition is filed and an adjoining county, any or all of the petitioners may be registered
voters of such adjoining county, and of the Municipal Township or Townships thereof
through which the proposed road may run, or in which the proposed road may begin or
terminate.
Attached is sample Petition, Signature sheet. Listing of Land Owners, and the Taney
County Road Classification System.
The Taney County Commission will assign a Road Classification to the road being
petitioned, should they deem that it is in the best interest of the public to establish said
road as a Taney County Public Road and include it in the road to be maintained by the
County. There is included a form on which the petitioners may request the lowest
classification they are willing to accept for the road being petitioned. A selection of that
class should be made and the form signed by all those signing the petition. The County
Commission takes this into consideration when making their decision as to the County's
ability to maintain any new roads in certain classifications. The County Commission may
possibly request additional information or commitments prior to making its final
decision.

We, the undersigned citizens of said County, at least twelve duly qualified and competent adult
petitioners, residents of registered voters in the townships hereinafter named, three of whom reside
in the immediate neighborhood of the following described proposed road, respectfully represent
and aver that the proposed public road hereinafter described is ______ feet in width, and situated in
the township of _______________________, in the County of _________________, and State of
Missouri, and is of sufficiently great utility to the general public, and that the beginning, courses
and terminations thereof, with not less than two points named on the direction of said public road

willing to give the right of way for said proposed public road. And we further aver that as and for
public notice of this application not less than three triplicate original written handbills were by said
petitioners duly put in not less than three distinct, separate and independent public places in said
townships, one at the proposed beginning of said public road, and one at the proposed termination

Based upon the Taney County Road Classification System we the undersigned petitioners
