TANEY COUNTY BOARD OF ADJUSTMENT

Call to Order
The Board of Adjustment held a meeting on January 20, 2021 at 6:00 p.m. located at the Taney
County Courthouse in the County Commission Hearing Room at 132 David Street, Forsyth,
Missouri. Chairman Trent Edwards called the meeting to order at 6:00 p.m. Scott Starrett
established a quorum and an explanation of public hearing procedures, presentation of exhibits
and governing statutes.

Also present was Planning and Zoning Administrator, Scott Starrett and Zoning Coordinator,
Presley Cozort.

Review and Action
Mr. Starrett opened the floor for nominations for Chairman. Mr. Persinger nominated Mr.
Edwards. No other nominations were made. The nomination passed by voice vote: Trent
Edwards (abstain), David Herd (aye), Rick Caudill (aye), Cory Roebuck (aye) and Rick
Persinger (aye).

Mr. Edwards opened the floor for nominations for Vice Chairman. Mr. Persinger nominated
David Herd. No others were nominated. The nomination passed by voice vote: Trent Edwards
(aye), David Herd (abstain), Rick Caudill (aye), Cory Roebuck (aye) and Rick Persinger (aye).

Mr. Caudill moved to approve the Regular Meeting Minutes from December 16, 2020. Mr. Herd
seconded the motion. The motion passed by voice vote: Trent Edwards (aye), David Herd (aye),
Rick Caudill (aye), Cory Roebuck (aye) and Rick Persinger (aye).

Mr. Edwards swore everyone in who planned on speaking during the meeting.
Public Hearings
#20-22V: Representative Dale Westphal was present for applicant Karen Felts. Paul Greene was
present to speak against the application. Mr. Herd moved to approve five foot requested setback,
allowing that there is proper water drainage and no electrical issues with the power easement
behind it. The motion died from lack of a second. Mr. Roebuck moved to deny variance. Mr.
Persinger seconded the motion. The motion passed by voice vote: Trent Edwards (aye), David
Herd (nay), Rick Caudill (aye), Cory Roebuck (aye) and Rick Persinger (aye).

#20-23V: Representative Bernard Dougherty was present for Brownbranch Holdings LLC. Mr.
Caudill moved to accept variance as requested. Mr. Roebuck seconded the motion. The motion
passed by voice vote: Trent Edwards (aye), David Herd (aye), Rick Caudill (aye), Cory Roebuck
(aye) and Rick Persinger (aye).

#20-24V: Applicant Mohamed Bakry was present. Richard Schmidt, Beu Jennings, Billy
Berringer and Bruce Boushehri were present to speak for the application. Scott Brinley was
present to speak against the application. Mr. Persinger moved to approve the variance as
requested. Mr. Herd seconded the motion. The motion passed by voice vote: Trent Edwards
(aye), David Herd (aye), Rick Caudill (aye), Cory Roebuck (nay) and Rick Persinger (aye).

#20-07A: Representative Michelle Torres was present for L&J Log Cabins Ridgedale LLC
appeal. Tim Davis, Michael Hyams and Tim Schafer were present to speak for the application.
Don Ingrum was present to speak against the application. Mr. Roebuck moved to deny the
appeal. Mr. Herd seconded the motion. The motion passed by voice vote: Trent Edwards (aye),
David Herd (aye), Rick Caudill (aye), Cory Roebuck (aye) and Rick Persinger (nay).

#20-08A: Representative Michelle Torres was present for L&J Log Cabins Ridgedale LLC
appeal. Tim Davis and Tim Schafer were present to speak for the application. Don Ingrum was
present to speak against the application. Mr. Roebuck moved to deny the appeal. Mr. Herd
seconded the motion. The motion passed by voice vote: Trent Edwards (aye), David Herd (aye),
Rick Caudill (aye), Cory Roebuck (aye) and Rick Persinger (nay).

#20-09A: Representative Amber English was present for Triple G Ranch LLC. Jamie McLeod
was present to speak against the application. Mr. Roebuck moved to deny the appeal. Mr. Caudill
seconded the motion. The motion passed by voice vote: Trent Edwards (aye), David Herd (aye),
Rick Caudill (aye), Cory Roebuck (aye) and Rick Persinger (nay).

#20-10A: Applicant Darlene Bird was present. Tim Bird was present to speak for the application.
Spencer Jones, Bryan Wade and Tim Davis was present to speak against the application. Mr.
Herd moved to deny the application. Mr. Caudill seconded the motion. The motion passed by
voice vote: Trent Edwards (aye), David Herd (aye), Rick Caudill (aye), Cory Roebuck (nay) and
Rick Persinger (aye).
Reconsideration Request
Requester James Webb was present. Mr. Herd moved to deny the reconsideration request. Mr.
Caudill seconded the motion. The motion passed by voice vote: Trent Edwards (aye), David
Herd (aye), Rick Caudill (aye), Cory Roebuck (aye) and Rick Persinger (aye).

Rehearing Request
Requester James Webb was present. Mr. Caudill moved to deny the request for hearing. Mr.
Roebuck seconded the motion. The motion passed by voice vote: Trent Edwards (aye), David
Herd (aye), Rick Caudill (aye), Cory Roebuck (aye) and Rick Persinger (aye).

Mr. Roebuck moved to adjourn the meeting at 9:47 p.m. Mr. Caudill seconded the motion. The
