MINUTES
TANEY COUNTY BOARD OF ADJUSTMENT
TUESDAY, JULY 17, 2018, 6:00 P.M.
COUNTY COMMISSION HEARING ROOM
TANEY COUNTY COURTHOUSE

Call to Order:
Chairman Dan Boone called the meeting to order at 6:00 p.m. A quorum w a s
established with four members present. They were; Dan Boone, David Herd, Trent
Edwards, and new member Rick Persinger. Staff present; Scott Starrett and Bonita
Kissee-Soutee. The governing statutes were read by Mr. Starrett who also read a
statement outlining the procedures for this meeting and presented the exhibits. Mr.
Boone swore in the speakers.

Review and Action:
Minutes, June 20, 2018; with no additions or corrections a motion was made by
Mr. Herd to approve the minutes as written. Seconded by Mr. Edwards. Mr. Persinger
abstained. The vote to approve the minutes was three in favor with one abstention.

Rehearing Request:
Christiaan Horton; request for a rehearing regarding Board of Adjustment
approval of an appeal for permit #18-06A on June 20, 2018 to deny Division III Special­
i s e permit #18-010 located at 122 Fieldstone Dr. for nightly rental. Mr. Starrett
clarified the request. Mr. Boone explained to the applicants that he only wanted to see
information. Megan McCullough representing the applicant presented two new exhibits
depicting all the nightly rentals in the neighborhood, proving in her opinion
compatibility. After discussion a motion was made by Mr. Edwards to approve a
rehearing. Seconded by Mr. Persinger. The vote to approve the rehearing was three in
favor and one against.

Turkey Crossing, LLC; request for rehearing of an appeal of a Planning
Commission decision regarding Case #18-013 to deny nightly rental for six cabins
located at Jones and Seiler Roads. Mr. Starrett clarified the request and presented a
location map of the site. Mr. Boone stated that he wanted new evidence in order to
rehear. Ms. Budd representing the request presented new evidence in her opinion,
stating that there was confusion among the Boards whether a Division III Permit or a
special use permit should be applied for. Mr. Starrett explained the difference in the
permits. Also she stated that there is eight acres next to the property that is under
contract which will change the concept of this request. After discussion a motion was
made by Mr. Persinger to grant the rehearing. Seconded by Mr. Herd. The vote to
rehear was unanimous. Discussion followed.
Public Hearings:
18-06V; Terry McArthur/proposed property line variance located at 115 G ab rie l
Lane. Mr. Starrett presented a staff report and location maps of the site. Mr. M cA rthu r
representing owner Lance Fisher was present to address the request. He stated t h a t
since the property is so small almost his whole back yard is lateral field preventing a
pump out truck to access his septic tank. So if the variance is granted the truck co u ld
back in alongside the other side of the house and yard. Mr. Edwards pointed out th a t
most of the lots in the subdivision are odd shaped. The next door .neighbor Mr. F ish e r is
in favor according to Mr. Fisher. After discussion a motion was made by Mr. Edw ards to
approve the request. Seconded by Mr. Persinger. The vote to approve the variance
request was unanimous.

Old and New Business:
No discussion.

Adjournment:
With no other business on the agenda for July 17, 2018 the meeting adjourned
at 6:25 p.m.

MONDAY, JULY 9, 2018, 6:30 P.M.
COUNTY COMMISSION HEARING ROOM
TANEY COUNTY COURTHOUSE

Call to Order:
Chairman Dan Boone called the meeting to order at 6:30 p.m. A quorum w a s
established with five members present. They were; Dan Boone, Howard Kitchen, David
Herd, Trent Edwards, and new member Rick Persinger. Staff present; Scott Starrett,
and Bonita Kissee-Soutee.

A motion was made by Mr. Edwards to go into closed session pursuant to RSMO
610.021 (1) (legal), seconded by Mr. Kitchen. The vote to go into closed session w a s
unanimous.

Mr. Starrett introduced Mr. Travis Elliott, legal counsel for the County.

Adjournment:
With no other business on the agenda for July 9, 2018, no motions made and no
votes taken, Mr. Herd made a motion to adjourn closed session for the Board of
Adjustment. Seconded by Mr. Edwards. The vote to come out of closed session was
unanimous. The meeting adjourned at 7:53 p.m.
