> EMERGENCY EVENT PROCUREMENT

Taney County Emergency Procurement Policy (PER RSMo. # 50.780.2): Notwithstanding any other provisions of
this Policy the Taney County Commission may waive the requirement of competitive bids or proposals for supplies
when the County Commission has determined that there exists a threat to life, property, public health, or public safety
or when immediate expenditure is necessary for repairs to County property in order to protect against further loss of,
or damage to, County property, to prevent or minimize serious disruption in County services or to ensure the integrity
of County records. Emergency procurements shall be made with as much competition as is practicable under the
circumstances. After an emergency procurement is made by the County Commission, the nature of the emergency
and the vote approving the procurement shall be noted in the minutes of the next regularly scheduled meeting. A
written determination of the basis for the emergency and for the selection of the particular contractor shall be included
in the contract file. As soon as practicable, a record of each emergency procurement shall be made including the
contractor’s name, amount and type of the contract, a listing of the item(s) procured under the contract. The County
Purchasing Agent will assign a specific Emergency Event Procurement number (“EEP”) for each event to cover all
emergency purchases made within the necessary recovery timeframe as set by the Taney County Commission.

The following is a list of questions that must be answered when making emergency procurement requests.
This is a formal document for submission to the Commission for the requesting department.

1. Please describe the reason for the request of emergency procurement with respect to the
threat to public health, welfare, or safety: We have two backhoes assigned to the Taney County
Transfer Station to pack trash into trailers. When one is in need o f repair we have to use the backup
machine. Most repairs are routine and completed quickly to avoid disruption o f service. That is not
the case now as the part needed here is major. To take time to let this out for bid will create a
definite risk o f unnecessary revenue loss to the County by a potential disruption in County services
should we have to close down the Taney County Transfer Station. This would be the situation
should the backup unit also breakdown.

2. Describe anticipated consequences of not procuring immediately: This m ajor repair will take at
least a week even with immediate approval right now. Downtime is critical, so if the other machine
m ight breakdown, as mentioned above, we will have to shut down the entire Transfer Station until
all repairs are completed. This, o f course, would create an unknown disruption in the services we
currently offer to the public, private as well as commercial. Public relations as well as revenue flow
would be greatly damaged. Therefore we ask for approval for this immediate procurement o f these
parts to avoid all o f the possible problems listed here.

3. Describe and attach any quotes received: Potter equipment $15,000.00. Coleman Equipment
$14,695.00. Broken Tractor, LLC. offered the much lower estimate of; $5,695.00 via a used part.

4. Is this a one-time purchase? S Yes o r _____ No. If not, detail the anticipated future
purchases with anticipated acquisition dates:

Monday May 30, 2017: As directed by the indicated state statute the nature of this emergency procurement
was brought before the Taney County Commission where after a brief discussion a motion was made for
Presiding Commissioner Scofield to approve and sign as such. Said vote being unanimous to approve the
procurement was finalized, signed accordingly, and noted in the formal minutes.
