Reg u lations.

4.7.19. Re v o c a tion------
T h e Pla n n ing De partm e nt is he re by au tho riz ed to revoke a ny N ig h tly Re ntal Spec ia l-Use
Pe rm it issued unde r th e te rms o f th is Sec tion, if, afte r due inves tigation, it dete rm ines that
the holde r th ereo f has re pea ted ly violate d any provis ions o f th is Sec tion or that any
facility is be ing m aintained in an unsanitary or unsafe m anne r, or is a n u isa nce .

4.7.20. Lim ita tion of Lia b ility
T an ey C ounty assum es no responsibility fo r th e ope ration o f th e s ite and O w ne r
cove nants afid agrees to hold T ane y C ounty harm less fo r any injury or da m age w h ich
m ay occur, of w ha teve r type or nature , as the re sult of th e ope ra tion o f the Nig h tly Re ntal.
O w ne r shall m a intain a pp ro priate lia b ility insurance for th e N ig h tly Re n tal. O w ne r fu rth e r
w arrants and agrees to co m p e nsate T an ey C ounty for any expe nse incurred in th e
defe nse o f any law suit or o th e r type o f ac tion w h ich may be brought a ga inst said County
as a re su lt o f sa id O w ne r’s ope ration o f th is use .

Reasoning for Removal of Nightly Rental Regulations
Development Guidance Code
• Nightly Rental is a key part of the economic engine for the tourism driven local economy
of Taney County, MO. Restrictive nightly rental regulations may actually damage the
local economy which relies heavily on nightly rental units to serve the estimated 7.2
million visitors that visit the Tri-Lakes area annually. The area simply does not have an
adequate number of lodging rooms in hotels to meet this demand. Therefore the demand
is met by a large number of lodging sources, including nightly rental.
• Requiring a Division III Special-Use Permit for every Nightly Rental may simply not be
feasible with current Planning Department Staffing levels. For example the Vacation
Rental By Owner (VRBO) website lists 1,327 rentals for Branson, 1,099 rentals for
Hollister and 1,027 rentals for Ridgedale. Many of these advertised rentals are single­
family residences within subdivisions that did not receive an original Division III Permit
specifically authorizing nightly rental. VRBO is now one of many website that have
been established to advertise the nightly rental of properties on a worldwide basis.
Recent research from Pew shows that approximately a year ago, only 27% of Americans
were familiar with the concept of the “Sharing Economy”. According to this same
survey, today, nearly 60% of U.S. travelers are aware of nightly rental as a lodging
option.
• The Planning Commission itself may simply not have the time that will be required to
hear each of the thousands of unheard Division III Special-Use Permit applications for
nightly rental properties within the unincorporated portion of Taney County.
• In a number of court cases throughout the United States nightly rental / short term rental
has been viewed by the courts as a residential use versus a commercial use; much like the
monthly rental of properties, which most counties and cities do not regulate.
• If Planning & Zoning were to not regulate nightly rental, complaints of illegal activities
would still be handled by Sherriff s Office and other enforcement activities would be left
to individual civil action and homeowners associations.
• Taney and Stone Counties are the only counties within the State of Missouri which are
currently regulating nightly rental.

11. Nightly Rental

11.1. Nightly R ental Definition
A residential building, structure or part th ereo f that may be rented for any period o f tim e
less than thirty (30) calendar days, counting portions of days as full days. The term
— Nightly Rental shall not include hotel, motel, or bed and breakfast establishm ents.

11.2. Perm itting R equirem ents
A d eveloper m ay apply for a Division III Perm it authorizing the N ightly Rental o f units
w ithin a developm ent. A Division III Perm it w ill only be issued fo r Nightly Rental in
instances in w hich either the entire developm ent shall allow for N ightly Rental or the
num ber and location o f Nightly Rental units shall be specifically enum erated w ithin the
Decision o f Record. All individual property ow ners shall obtain a Division II Perm it for
Nightly Rental. Division II Nightly Rental Perm its m ay only be issued fo r properties that
dem onstrate com pliance with sections 11.3 through 11.19.

11.3. O ccupancy
The m axim um occupancy for a Nightly Rental shall be tw o (2) persons per dw elling unit,
plus tw o (2) persons per bedroom (e.g., a tw o (2) bedroom dwelling unit is perm itted a
m axim um occupancy o f six (6) persons). The m axim um occupancy shall be further
limited based upon the capacity o f the w astew ater treatm ent system serving the Nightly
Rental, off-street parking requirem ents and local fire district occupancy limits, w hichever
is lesser. Please note that the term p erso n for the purpose o f establishing occupancy is
defined as an individual at least four (4) years o f age. Please note that the term
bedroom as used in reference to Nightly Rental is defined as a room utilized prim arily for
sleeping that shall have a floor area of not less than 70 square feet, shall not be less than
7 feet in any horizontal direction and shall contain at a m inim um a door, a w indow and a
closet.

114. Parking
One (1) off-stre e t parking space shall be provided fo r each tw o (2) persons o f occupancy
in a N ightly Rental. All Nightly Rentals shall provide clearly m arked and appropriately
situated parking spaces for the handicapped, one (1) such space in each parking area.
No m ore vehicles shall be parked on the property than there are designated off-street
parking spaces. Inability to provide the required off-street parking will reduce the
perm itted occupancy. A site plan shall be subm itted with an application for a Nightly
Rental S pecial-U se Perm it which identifies the location o f the required off-street parking.

115 Solid W aste Disposal
The m anagem ent com pany or a w aste collection provider shall provide w eekly solid
w aste collection during all m onths that the Nightly Rental is available fo r rent.

11.6. Lighting
O utdoor lighting shall be dow nw ard lit, subdued and have m inim al off-site im pacts to
adjoining properties.

11.7. Safety
All N ightly Rentals shall contain a m inim um o f one operable fire extinguisher, operable
sm oke alarm s and operable carbon m onoxide alarm s in com pliance with the local fire
district regulations, w here applicable.

11.8. Fire D istrict C om pliance
Prior to the issuance o f a C ertificate o f C onform ance, a com pliance letter shall be
subm itted from the local fire district, ensuring adequate fire suppression and the provision
of occupancy limits.

11.9. Taney C ounty A ssesso r’s Office C om pliance
A com pliance letter shall be subm itted from the Taney C ounty A sse sso r’s O ffice prior to
the issuance o f a C ertificate o f Com pliance.

11.10. M issouri D epartm ent of R evenue C om pliance
A valid M issouri D epartm ent o f Revenue Sales Tax License shall be provided to the
Planning D epartm ent prior to the issuance o f a C ertificate o f C om pliance. A No T ax Due
Letter from the M issouri D epartm ent o f Revenue shall be subm itted to the Planning
D epartm ent office annually, indicating that the sales taxes have been paid.

11.11. Perm it Posting
The Nightly Rental Special-U se Perm it shall be posted within five (5) feet o f the main
entrance o f each dwelling unit, both on the inside and on the outside o f the dwelling unit,
and contain the following inform ation:
(a) The nam e and telephone num ber o f the Local Representative.
(b) The nam e and address o f the Owner.
(c) The contact inform ation for the Planning D epartm ent and S h e riffs D epartm ent office
in Taney County.
(d) The m axim um occupancy permitted.
(e) The nam e and telephone num ber o f all local em ergency personnel (police, fire and
m edical personnel).
(e) The num ber o f off-street parking spaces provided on the property, and the m axim um
num ber of vehicles allowed to be parked on the property.
(f) The solid w aste disposal collection day if provided by a solid w aste com pany.

11 . 12 . O w nership
A N ightly Rental Special-U se Perm it is issued to a specific “O w ner” o f a property. If the
property changes ow nership then the Special-U se Perm it shall im m ediately expire.

11.13. Local 24-H o u r R epresentative
The O w ner of the property shall designate a “ Local R epresentative”. The Local
R epresentative shall be available on a tw enty-four (24) hour basis, seven days per week.
The Local R epresentative may be the owner, a property m anagem ent com pany
representative, agent, designee or other person em ployed, authorize or engaged by the
ow ner to m anage, rent or supervise the Nightly Rental. The Local R epresentative shall
m aintain a residence or perm anent place o f business within either Taney C ounty or the
C ounties adjoining Taney C ounty and shall be available on a tw enty-four (24) hour basis,
even (7) days per week.

(e) C hange Local R epresentative
The Local R epresentative may be changed by the O w ner from tim e to tim e
throughout the term o f the permit, by the O w ner filing a revised perm it application that
includes the name, address and telephone num ber o f the new Local R epresentative.
Failure to notify the C ounty of a change in the Local R epresentative constitutes a
Violation pursuant to Section 3.10 and m ay also lead to the revocation o f the Special-
Use Permit.

(f) G uest and V ehicle R egister
The Local R epresentative shall m aintain a guest and vehicle register for each
tenancy o f the Nightly Rental. The register shall include the nam es, hom e addresses,
and telephone num bers o f the occupants and the vehicle license plate num bers o f all
vehicles used by the occupants and the date o f the rental period. The above
inform ation m ust be available fo r C ounty inspection upon request. Failure to
m aintain or provide the required inform ation constitutes a Violation per the provisions
ofSection 3.10 and m ay also lead to the revocation o f the S pecial-U se Permit.

(g) Com plaints
T he Local R epresentative m ust be authorized by the O w ner to respond to questions
or concerns from the occupants or neighbors. The Local R epresentative shall serve
as the initial contact person if there are questions or com plaints regarding the
operation o f the property as a Nightly Rental. The Local R epresentative m ust
respond to those com plaints in a tim ely m anner to ensure that the use o f the property
com plies with the standards for Nightly Rental occupancy, as well as other pertinent
County code requirem ents pertaining to noise, disturbances, or nuisances, as well as
State law pertaining to the consum ption o f alcohol, or the use o f illegal drugs.

11.14 Required Buffering
A buffer shall be established between any structure utilized fo r N ightly Rental and any
existing single-fam ily residential land use, m eeting the requirem ents o f A ppendix H,
Section 6 (Technical Plans).

11.15 A dditional Conditions
The Taney C ounty Planning C om m ission may, at their discretion, im pose additional
conditions or stipulations that it deem s necessary.

11.16. C om pliance
C om pliance with the term s and conditions set forth herein shall be the non-delegable
responsibility o f the ow ner o f the Nightly Rental; and each o w ner o f a N ightly Rental shall
be strictly liable fo r com plying with the conditions set forth in this Section or im posed by
Taney C ounty. T he O w ner shall com ply with all applicable County, State and Federal
Regulations.

11.18. Revocation
The Planning D epartm ent is hereby authorized to revoke any Perm it authorizing Nightly
Rental w hich is issued under the term s of this Section, if, after due investigation, it
determ ines that the holder th ereo f has repeatedly violated any provisions o f this Section
or that any facility is being m aintained in an unsanitary or unsafe manner, or is a
nuisance.

1119. Lim itation of Liability
Taney C ounty assum es no responsibility for the operation o f the site and O w ner
covenants and agrees to hold Taney C ounty harm less fo r any injury or dam age which
may occur, o f w hatever type or nature, as the result o f the operation o f the N ightly Rental.
O w ner shall m aintain appropriate liability insurance for the N ightly Rental. O w ner further
w arrants and agrees to com pensate Taney C ounty for any expense incurred in the
defense o f any law suit or other type o f action which may be brought against said County
as a result o f said O w ner’s operation o f this use.

4. PER M ITS

4.1. Types o f Perm its

The types o f perm its available are defined below. However, to aid in determ ining w hat type of
perm it is required for a developm ent project, the decision flow chart o f A ppendix A can be used
so sim plify the selection process.

4.1.1. Division I Permits
A perm it required fo r any o f the follow ing conditions:
(a) new single-fam ily dwelling (including m anufactured h om es)
(b) any addition to construction originally requiring a Division I perm it
(c) any addition to a single-fam ily unit
(d) special events
(e) any accessory building, structure, or appurtenance (shed, deck, porch, car port,
etc.) greater than 100 square feet in ground coverage w hich is not classified as an
agricultural structure (agricultural structures are exem pt from all perm itting
requirem ents; residential structures are not considered exem pted as agricultural
structures and do require perm its for purposes o f com pliance with setbacks)
(f) tem porary construction facilities placed on a d evelopm ent site after receiving
Division II or III perm its

Note: All requests that do not specifically fall within the above listed situations shall
autom atically be considered either a Division II or III perm it request.

4.1.2. Division II Perm its

4.7. Nightly Rental

A residential building, structure or part thereof that m ay be rented fo r any period o f tim e less than
thirty (30) calendar days, counting portions of days as full days. The term — Nightly rental shall
not include hotel, motel, or bed and breakfast establishm ents.

Nightly Rentals in a residential area have the potential to be incom patible with the surrounding
residential uses. Therefore, special regulation o f N ightly Rentals w ithin areas that have not been
issued a Division III Perm it specifically authorizing Nightly Rental, are necessary in order to
ensure that th eir use will be com patible with surrounding residential uses and will not m aterially
alter the neighborhoods in which they are located. A Special-U se Perm it m ay be issued by the
Planning C om m ission, provided that the follow ing requirem ents and lim itations are adhered to:

(a) Such use does not endanger public health or safety, or create a public nuisance.

(b) Such use does not adversely affect property values in the subdivision, neighborhood, or
area.

(c) Such use is com patible with the existing uses in the subdivision, neighborhood, or area.

(d) Such use’s vehicle traffic and noise levels are com patible with the existing uses in the
subdivision, neighborhood, or area.

(e) Such use com plies with the provisions o f Section 11.

11. Nightly Rental

11.1. Nightly Rental Definition
A residential building, structure or part th ereo f that may be rented fo r any period o f tim e
less than thirty (30) calendar days, counting portions of days as full days. The term
— N ightly Rental shall not include hotel, motel, or bed and breakfast establishm ents.

11.2 Perm itting R equirem ents
A d eveloper may apply for a Division III Perm it authorizing the N ightly Rental o f units
w ithin a developm ent. A Division III Perm it will only be issued fo r Nightly Rental in
instances in which either the entire developm ent shall allow for N ightly Rental or the
num ber and location o f Nightly Rental units shall be specifically enum erated w ithin the
Decision o f Record. Individual property ow ners within a developm ent with valid Division
III Perm it Nightly Rental authorization shall not be required to obtain a Division III
Special-U se Perm it for Nightly Rental. However, the construction o f each N ightly Rental
unit shall be authorized via a Division II Permit. Nightly Rental proposals that do not have
valid Division III Perm it authorization fo r the developm ent / subdivision shall follow the
S pecial-U se Perm itting requirem ents and procedures enum erated w ithin A p pe n dix E and
also the provisions of Section 11.

11.3. O ccupancy
The m axim um occupancy for a N ightly Rental shall be tw o (2) persons per dw elling unit,
plus tw o (2) persons per bedroom (e.g., a two (2) bedroom dwelling unit is perm itted a
m axim um occupancy o f six (6) persons). The m axim um occupancy shall be further
limited based upon the capacity o f the w astew ater treatm ent system serving the Nightly
Rental, off-street parking requirem ents and local fire district occupancy limits, w hichever
is lesser. Please note that the term perso n fo r the purpose o f establishing occupancy is
defined as an individual at least fo ur (4) years o f age. Please note that the term
b edroom as used in reference to Nightly Rental is defined as a room utilized prim arily for
sleeping that shall have a floor area of not less than 70 square feet, shall not be less than
7 feet in any horizontal direction and shall contain at a m inim um a door, a w indow and a
closet.

11.4. Parking
One (1) off-street parking space shall be provided fo r each tw o (2) persons o f occupancy
in a N ightly Rental. All Nightly Rentals shall provide clearly m arked and appropriately
situated parking spaces for the handicapped, one (1) such space in each parking area.
No m ore vehicles shall be parked on the property than there are designated off-street
parking spaces. Inability to provide the required off-street parking will reduce the
perm itted occupancy. A site plan shall be subm itted with an application for a Nightly
Rental S pecial-U se Perm it which identifies the location o f the required off-street parking.

11.5. Solid W aste Disposal
The m anagem ent com pany or a w aste collection provider shall provide w eekly solid
w aste collection during all m onths that the Nightly Rental is available for rent.

116 Lighting
O utdoor lighting shall be dow nw ard lit, subdued and have m inim al off-site im pacts to
adjoining properties.

11.7. Safety
All N ightly Rentals shall contain a m inim um o f one operable fire extinguisher, operable
sm oke alarm s and operable carbon m onoxide alarm s in com pliance with the local fire
district regulations, w here applicable.

11.8. Fire D istrict C om pliance
Prior to the issuance o f a C ertificate o f C onform ance, a com pliance letter shall be
subm itted from the local fire district, ensuring adequate fire suppression and the provision
o f occupancy limits.

11.9. Taney C ounty A ssesso r’s Office C om pliance
A com pliance letter shall be subm itted from the Taney C ounty A s s e s s o r’s O ffice prior to
the issuance o f a C ertificate of Com pliance.

11.10. M issouri D epartm ent of R evenue C om pliance
A valid M issouri D epartm ent o f Revenue Sales Tax License shall be provided to the
Planning D epartm ent prior to the issuance o f a C ertificate o f C om pliance. A No T ax Due
Letter from the M issouri D epartm ent o f Revenue shall be subm itted to the Planning
D epartm ent office annually, indicating that the sales taxes have been paid.

11.11. Perm it Posting
The Nightly Rental Special-U se Perm it shall be posted w ithin five (5) feet o f the main
entrance o f each dwelling unit, both on the inside and on the outside o f the dw elling unit,
and contain the follow ing information:
(a) The name and telephone num ber o f the Local Representative.
(b) The nam e and address o f the Owner.
(c) The contact inform ation for the Planning D epartm ent and S h eriff’s D epartm ent office
in Taney County.
(d) The m axim um occupancy permitted.
(e) The name and telephone num ber o f all local em ergency personnel (police, fire and
m edical personnel).
(e) The num ber o f off-street parking spaces provided on the property, and the m axim um
n um ber of vehicles allowed to be parked on the property.
(f) The solid w aste disposal collection day if provided by a solid w aste com pany.

11.12. O w nership
A N ightly Rental Special-U se Perm it is issued to a specific “O w ner” o f a property. If the
property changes ow nership then the S pecial-U se Perm it shall im m ediately expire.

11.13. Local 24-H o u r R epresentative
The O w ner o f the property shall designate a “ Local R epresentative” . T he Local
R epresentative shall be available on a tw enty-four (24) hour basis, seven days per week.
The Local R epresentative may be the owner, a property m anagem ent com pany
representative, agent, designee or other person em ployed, authorize or engaged by the
ow ner to m anage, rent or supervise the Nightly Rental. The Local R epresentative shall
maintain a residence or perm anent place o f business within either Taney C ounty or the
Counties adjoining Taney C ounty and shall be available on a tw enty-four (24) hour basis,
even (7) days per week.

(e) C hange Local R epresentative
The Local R epresentative m ay be changed by the O w ner from tim e to tim e
throughout the term of the permit, by the O w ner filing a revised perm it application that
includes the name, address and telephone num ber o f the new Local Representative.
Failure to notify the C ounty o f a change in the Local R epresentative constitutes a
Violation pursuant to Section 3.10 and m ay also lead to the revocation o f the Special-
Use Permit.

(f) G uest and V ehicle R egister
The Local R epresentative shall m aintain a guest and vehicle register fo r each
tenancy o f the Nightly Rental. The register shall include the nam es, hom e addresses,
and telephone num bers o f the occupants and the vehicle license plate num bers o f all
vehicles used by the occupants and the date o f the rental period. The above
inform ation m ust be available fo r C ounty inspection upon request. Failure to
m aintain or provide the required inform ation constitutes a Violation per the provisions
ofSection 3.10 and m ay also lead to the revocation o f the Special-U se Permit.

(g) C om plaints
The Local R epresentative m ust be authorized by the O w ner to respond to questions
or concerns from the occupants or neighbors. The Local R epresentative shall serve
as the initial contact person if there are questions or com plaints regarding the
operation o f the property as a Nightly Rental. The Local R epresentative m ust
respond to those com plaints in a tim ely m anner to ensure that the use o f the property
com plies with the standards for Nightly Rental occupancy, as well as other pertinent
C ounty code requirem ents pertaining to noise, disturbances, or nuisances, as well as
State law pertaining to the consum ption o f alcohol, or the use o f illegal drugs.

11.14. R equired Buffering
A buffer shall be established between any structure utilized for Nightly Rental and any
existing single-fam ily residential land use, m eeting the requirem ents o f A ppendix H,
Section 6 (Technical Plans).

11.15. A dditional C onditions
The T aney C ounty Planning C om m ission may, at their discretion, im pose additional
conditions or stipulations that it deem s necessary.

11.16. C om pliance
C om pliance with the term s and conditions set forth herein shall be the non-delegable
responsibility o f the ow ner o f the Nightly Rental; and each ow ner o f a N ightly Rental shall
be strictly liable fo r com plying with the conditions set forth in this Section or im posed by
Taney County. The O w ner shall com ply with all applicable County, State and Federal
Regulations.

11.18. R evocation
The Planning D epartm ent is hereby authorized to revoke any P erm it authorizing Nightly
Rental w hich is issued under the term s of this Section, if, after due investigation, it
determ ines that the holder thereof has repeatedly violated any provisions o f this Section
or that any facility is being m aintained in an unsanitary or unsafe m anner, or is a
nuisance.

11.19. Lim itation of Liability
Taney C ounty assum es no responsibility for the operation o f the site and O w ner
covenants and agrees to hold Taney C ounty harm less fo r any injury or dam age which
may occur, o f w hatever type or nature, as the result o f the operation o f the N ightly Rental.
O w ner shall m aintain appropriate liability insurance for the Nightly Rental. O w ner further
w arrants and agrees to com pensate Taney C ounty for any expense incurred in the
defense o f any law suit or other type of action which may be brought against said County
as a result o f said O w ner’s operation o f this use.

4. PER M ITS

4.1. Types o f Perm its

The types o f perm its available are defined below. However, to aid in determ ining w ha t type of
perm it is required fo r a developm ent project, the decision flow chart o f A ppendix A can be used
so sim plify the selection process.

4.1.1. Division I Perm its
A perm it required fo r any o f the follow ing conditions:
(a) new single-fam ily dwelling (including m anufactured h om es)
(b) any addition to construction originally requiring a Division I perm it
(c) any addition to a single-fam ily unit
(d) special events
(e) any accessory building, structure, or appurtenance (shed, deck, porch, car port,
etc.) greater than 100 square feet in ground coverage w hich is not classified as an
agricultural structure (agricultural structures are e xem pt from all perm itting
requirem ents; residential structures are not considered exem pted as agricultural
structures and do require perm its fo r purposes o f com pliance with setbacks)
(f) tem porary construction facilities placed on a d evelopm ent site after receiving
Division II or III perm its

Note: All requests that do not specifically fall within the above listed situations shall
autom atically be considered either a Division II or III perm it request.

4.1.2. Division II Perm its
A perm it required fo r any o f the follow ing conditions:
(a) new com m ercial, industrial, or institutional uses that have been issued a Division
III perm it
(b) any duplex that has been issued a Division III Perm it
(c) any three-fam ily or larger m ulti-fam ily structure that already has an approved
Division III perm it
(d) any addition to construction requiring a Division II permit, except additions to
single fam ily units
(e) church structures or additions
(f) construction o f a unit w ithin a developm ent that received Division III Perm it
authorization fo r nightly rental
