NOTICE OF INTENT TO DECLARE

On the date as listed above I delivered the below information to the Taney County Commission.
• The Taney County Purchasing Department released a NOTICE OF INTENT TO DECLARE NOTICE
on or about March 26, 2016 via both available newspapers within the county directing all possible
interested parties to a posting on the Taney County website.
• Our information package, as posted, included a detailed document which establishes Romaine
Companies as a Sole Source Provider for a Jail Shower Delicer and Destaph System.
• This information was available either directly on our website or by request to the Purchasing
Department.
• All of this as per RSMo. 50.783.
• Romaine Companies owns a sole patent on this system and the required products necessary for
Taney County to maintain certain health standards within the county jail facility.
• Subsequent to this one time purchase Romaine Companies will continue to be the sole provider of
products for this system.
Given these factors the Taney County Purchasing Department recommended: Romaine Companies. as
the single feasible source for this needed purchase. Allowing for all of the above information, at this
time I asked if anyone present had any questions. (No questions.)
At this point I made an announcement requesting that if in fact there was any person, or persons,
present who feels they, or their company can immediately offer an alternative to Romaine Companies
which is equally financially as beneficial as them to Taney County with all of the same advantages and
standards as required for the Taney County Jail, that they should please come forward.
Seeing no such person - I asked that a motion be made to declare Romaine Companies, of Tulsa, Ok.,
as Sole Source Provider for this purchase with the required stipulation that if at any future time an
alternative source for these products and service should identify itself, the Commission would then
immediately set aside this declaration. At such time Taney County will take other available statutorily
governed steps as required, acting in the best interest of the County, to legally procure these products
and services.
The Taney County Commission then made a motion to award as such as it passed unanimously.
