REQUEST: The applicant, V a lle ystream D evelopm ent, LLC is
seeking the approval of a M ajor S ubdivision plat for
Echo H ollow Estates, a tw e n ty-fo u r (24) lot
subdivision; w hile also requesting the approval of a
D ivision III Perm it authorizing a nightly rental land-use
fo r any of the tw e n ty-fo u r (24) lots in question.

BACKGROUND and SITE HISTORY:

On S e pte m be r 11, 1992 the Planning C om m ission approved D ivision III P erm it 1992-
0126A, authorizing the d eve lop m en t o f an RV Park and a com m ercial subdivision on a
total of app ro xim ate ly 77.5 total acres; referenced as the W ilderness C lub R V Resort,
Inc. A p p ro xim a te ly 66.5 acres w ere located on the south side of State H ighw ay 165,
with 11 acres being located on the north side of State H ighw ay 165. On June 22, 1994
the plat o f the W ilderness Club R V R esort w as signed by the Planning D e partm ent staff
and filed w ith the T an ey C ounty R ecorder of D eeds office.

On A u g u st 2 1 ,1 9 9 5 the Planning C om m ission denied the request by Pine W oods
V illage to rezone app ro xim ate ly 21.52 acres to develop up to 104 single fa m ily lots for
cabin style hom es. The prim ary concern noted dealt w ith density. On S e pte m be r 20,
1995 the Board of A d ju stm e n t granted an appeal to denial issued by the Planning
C om m ission, authorizing the deve lo p m e n t of the Pine W ood Village.

The app ro xim ate ly 8.77 acre tract of land in question is show n on m aps from both of the
two previous D ivision III Perm it files but appears to be show n in each file as a futu re
phase of the developm ent.

GENERAL DESCRIPTION:

The proposed 24 lot, Echo H ollow E states subdivision will be located on a total o f +/-
8.77 acres (per the A s s e s s o r’s Inform ation - Beacon). The a pp licant is seeking
Planning C om m ission prelim inary plat approval, allow ing fo r the creation of the 24 lot
M ajor S ubdivision. The app licant is fu rth e r seeking Planning C om m ission approval o f a
Division III P erm it authorizing the nightly rental o f tw e n ty-fo u r (24) log cabins th a t would
be constructed on the lots w ithin Echo H ollow E states subdivision. T he ap p lica n t has
indicated that the log hom es will range in size from app ro xim ate ly 1,500 to 2,500 square
feet.

REVIEW:

On July 19, 2012 the T a n e y C ounty C om m ission adopted the S ubdivision R egulations
fo r T an ey C ounty w h ich rem oved and separated the subdivision regulations from the
D evelo pm e nt G uidance Code. Per the provisions of the S ubdivision R egulations an
A d m in istra tive M inor S ubdivision is a division of land, into tracts less than ten (10) acres
in size, w ith not m ore than a total of six (6) tracts. T he refore a M ajor S ubdivision is
classified as any division of land into tracts less than 10 acres in size w hich does not fall
w ithin the classificatio n of adm in istra tive m inor subdivision. Echo H ollow Estates is
considered a M ajor S ubdivision requiring the plat approval of the P lanning C om m ission.
Per the provisions of M issouri R evised S tatute and the Subdivision R egulations,
prelim inary plat approval shall be based upon the p la t’s com pliance w ith the provisions
of the subdivision regulations.

The tw e n ty-fo u r (24) lots w ithin Echo H ollow Estates will be served by an existing T an ey
C ounty R egional S e w er D istrict m ain and an existing com m u nity well. T he required,
m inim um lot size fo r lots served via public sew er is 8,000 square feet, w ith a m inim um
road fron tag e of 70 fe e t per lot. All of the lots indicated on the subm itted sketch plan will
m eet the m inim um lot size and road fron tag e requirem ents.

The road rights-of-w ay serving the subdivision have been cleared fo r a num ber o f years
(the 2006 aerial pho tog ra phy via B eacon indicates som e level of clearing) and the w a ter
m ains, sew er m ains and electrical services has been put in place adjoining the futu re
roadw ays. H ow ever, prior to Final Plat approval, the app licant shall e ith e r install all of
the required public im provem ents or provide an appropriate security in com pliance with
the provisions of A rticle 8 o f the S ubdivision R egulations (P erform ance Bond from a
qualified insurance or bonding com pany, an Irrevocable Letter of C redit from a certified
lending institution or cash bond fo r 110% of the costs associated w ith the construction
o f the im provem ents). T he representative has subm itted an engineering grading,
roadw ay, storm drainage, sanitary sew er and w a te r plans

Per the provisions o f the T an ey C ounty Road Standards, Echo H ollow Estates w ill be
considered a High D ensity R esidential S ubdivision, requiring a 5 0 ’ right-of-w ay and a
3 1 ’ roadw ay w idth fo r all new subdivision roads. T he road surface shall be eithe r
asphalt or concrete.

The representative is proposing a green space area that will be m aintained via a
p ro p e rty o w n e rs a s s o c ia tio n .

The T an ey C ounty D evelopm ent G uida nce C ode defin es nightly rental as “A residential
building, structure, or part th e re o f th a t m ay be rented fo r any period of tim e less than
thirty (30) days, counting portions of days as full d a y s .” C urrently, the a pp licant w ould
have the ability to rent any of the tw e n ty-fo u r (24) residences fo r a period of th irty (30)
days or greater.

Per the nightly rental provisions o f the D e velo pm e nt G uidance Code, “T he m axim um
occup ancy fo r a N ightly Rental shall be tw o (2) persons per dw elling unit, plus tw o (2)
persons per b e d ro o m .” T herefore, the three (3) bedroom hom e w ould have a m axim um
occup ancy o f eight (8) people.

Per the nightly rental provisions o f the D e velo pm e nt G uidance Code, “O ne (1) off-street
parking space shall be provided fo r each tw o (2) persons of occup ancy in a N ightly
R ental.” T h e refore a total o f four (4) parking spaces will be required. T he residence is
currently served by a tw o (2) car attached garage and a parking area large enough to
a ccom m odate the additional two (2) cars. The property will m eet the m inim um parking
require m en ts of the D evelopm ent G uidance Code. T he representative is proposing a
parking e a se m e n t th a t w ill contained w ithin an existing 100’ w ide pow er line easem ent,
to allow fo r overflow parking for such item s as boat and recreational vehicles, as
indicated on the Sketch Plan.

T he adjoining property im m ediately to the north is a vacant tra ct of land ow ned by
W ilderness Club, Inc. T he adjoining property im m ediate ly to the south is the Pinew oods
V illage, a residential subdivision. T he adjoining property im m ediately to the e ast is the
W ilderness C lub RV Resort. The adjoining property im m ediately to the w e st is a vacant
tract o f land w ithin the m unicipal lim its o f Hollister.

The project received a score of -5 on the Policy C hecklist, out of a m axim um possible
score of 57. T he relative policies receiving a negative score consist o f e m e rgency w a ter
supply, solid w a ste disposal service, pedestrian circulation and traffic.

The sta ff recom m en ds that tw o sepa ra te votes be conducted regarding this proposal.
The first vote will need to be taken regarding p relim inary plat approval fo r Echo H ollow
Estates, based upon its com pliance w ith the provisions of the S ubdivision R egulations.
The second vote will be in regard to the D ivision III Perm it authorizing the nightly rental
land-use.

STAFF RECOMMENDATIONS:

If the T a n e y C ounty Planning C om m ission approves the P relim inary Plat fo r the Echo
H ollow S ubdivision, the follow ing require m en ts shall apply, unless revised by the
P lanning C om m ission:

1. T he a pp licant shall subm it a report signed and sealed by a registered engineer, in
co m p lia n ce with A rticle 6, Section 4 o f the S ubdivision R egulations, prior to
receiving final plat A pproval. T he E n g in e e r’s report shall include the follow ing
item s:
a. S to rm w a te r D rainage
b. W a te r S upply
c. W a ste w a te r D isposal
d. T ra ffic A n alysis / S treet C apacity

2. T he final plat shall be filed w ith the T an ey C ounty R ecorder o f D eeds w ithin two
(2) years of the date o f approval of the prelim inary plat. T he final plat m ay be
subm itted in phases w ith each phase covering a portion of the approved
prelim inary plat. If the final plat is subm itted in successive phases the d e ve lop er
w ill have one ye a r after each phase to record the final plat o f the next phase. The
P lanning C om m ission m ay grant an extension of tim e fo r final plat subm ission if it
finds th a t the conditions on w hich the prelim inary plat w as approved have not
changed substantially.

3. All of the require im provem ents as enum erated w ithin A rticle 8 of the Subdivision
R egulations shall either be installed or an appropriate security (P erfo rm ance Bond
from a qualified insurance or bonding com pany, an Irrevocable Letter of C redit
from a certified lending institution or cash bond fo r 110% of the costs associated
w ith the construction o f the im provem ents) shall be provided to the Planning
D e partm ent O ffice.

4. C om plia nce letters from the M issouri D epartm ent of Natural R esources, the
T a n e y C ounty R egional S ew er District, the T an ey C ounty Road & Bridge
D e partm ent and the e lectric coop erative ow ning the pow er existing pow er
ease m e n t shall be provided to the Planning D epartm ent office .(C h a p te r VI-V II)

5. All roads w ithin Echo H ollow E state shall be constructed in com pliance w ith the
T a n e y C ounty Road Standards.

6. D ivision I Perm its will be required fo r all applicable structures in the deve lop m en t
(C h a p te r 3 Sec. I Item B).

7. Prior to the issuance of D ivision I Perm its, the applicants shall ensure th a t the
app licable sew er and w a te r co n n ections are in place.

8. This decision is subject to all existing easem ents.

9. This D ecision of Record shall be filed with the T an ey C ounty R ecorder of Deeds
O ffice w ithin 120 days or the approval shall expire (C hap te r II Item 6).

STAFF RECOMMENDATION:

If the T an ey C ounty P lanning C om m ission approves the D ivision III P erm it authorizing
the nightly rental of the tw e n ty-fo u r (24) units w ithin Echo H ollow Estates, the follow ing
requirem ents shall apply, unless revised by the Planning C om m ission:

1. C om plia nce w ith the provisions o f the T an ey C ounty D e velo pm e nt G uidance
Code.

2. C om plia nce letters from the W e ste rn T an ey C ounty Fire P rotection D istrict and
the M issouri D e partm ent of R evenue; including all other entities w hich have
require m en ts governing a d e ve lo p m e n t of this nature shall be provided to the
P lanning D e partm ent office .(C h a p te r V I-V II)

3. A valid M issouri D epartm ent of R evenue Sales Tax License shall be provided to
the Planning D epartm ent prior to the issuance of a C ertificates of C om pliance.

4. No outside storage of e q u ipm ent or solid w a ste m aterials.

5. This decision is subject to all existing easem ents.

6. All reside nces utilized fo r nightly rental shall a ccom m odate (sleep) no m ore than
tw o (2) persons per dw elling unit, plus tw o (2) persons per bedroom . T he total
occup a n cy m ay be fu rth e r lim ited based upon the provisions of the W estern
T an ey C ounty Fire Protection D istrict require m en ts and regulations.

7. O ne (1) o ff-stre e t parking space shall be provided for each tw o (2) persons of
occup a n cy w ithin each N ightly R ental cabin.

8. This D ecision of Record shall be filed w ith the T aney C ounty R e co rd e r’s O ffice
w ithin 120 days or the approval shall expire (C hap te r II Item 6).

We are writing to you to express our concern and opposition to the nightly rental
business being proposed for the property located at Cedar Glade Drive ( Echo Hollow
Estates).

We have two concerns that we would like to bring to your attention. The first
concern is water supply. We are currently getting our water from a well that supports
this neighborhood. Several years ago we were required to ration our water due to the
drought conditions for a length of time. Our concern is that if we are to experience
another drought that there will not be enough water for the community.

Our second concern is concerning the zoning issue. We chose to live in this area
because it is a residential area with covenants that protect us and that we must abide
by. Please see the attached residential protective covenants that were given to us that
govern Pine Woods Village. Article number seven restricts the rental of any property in
Pine Woods Village to a minimum of six months unless the developer approves of it.
The same developer is now selling the property which is within 600 feet of Pine Woods
Village and the Wilderness Club (which they developed and also has restrictive
covenants) to a developer for nightly rentals. Thank you for your time to hear our heart

RESIDENTIAL PROTECTIVE •COVENANTS

This Declaration made this day of /Jo _______ 1996, by WILDERNESS
CLUB. INC., hereinafter called the "DEVELOPER" having us principal place of business at South
Highway 165. Hollister. MO 65672. Taney County, Missouri.

WHEREAS, the DEVELOPER is the owner of certain land in Taney County, Mirsomi, more
particularly described in Exhibit HA" nttediod hereto; and

WHEREAS, it is the DEVELOPER’S intention that the aforesaid laud shall be developed as
a residential subdivision.

NOW, THEREFORE, ilie DEVELOPER declares that the aforesaid laud is held and shall be
conveyed by it subject to: (a) the following covenants and restrictions shall run with the land for
twenty-five (25) years fiomthe date hereof after which time they shall be automatically extended for
successive periods o f ten (10) years each unless an instrument, signed by the then owners of a
majority o f all of the Jots platted on said land, agreeing to change or remove such covenants and
restrictions in whole or in part shall have been recorded and (b) the easements referred iu Paragraph
2 hereof, uliich are reserved to the DEVELOPER, its successors and assigns, shall be perpetual in
duration and run with and bind forever t-ie land and the owner thereof their heirs, succftssors and
assigns.

1, No structure shall be erectcd, altered, placed or permitted to remain on any lot other
lhan dwellings and accessory buildings such as gardens, garden houses and the like.
No trailer, basement, tent, shack, garage or any other outbuilding or any structure of
a temporary character erected oo any lot shall at any time be used as a r e s i d e n c e ,
either temporary or pamanetit. No outside toilets shall be allowed.

2. (a) No part o f any building shall be located nearer than twenty-five (25) fee; to
ilie front lot line or nearer than five (5) feet to the rear lot line or nearer than
five (5) fect from the side lot line; except that on Iotjpoiding on two streets,
no other building shall be nearer than twenty-five ( if f f e e t from any street.
Notwithstanding the foregoing, from and after such time as two or more
contiguous lots running on the same street arc used as a single building site,
such contiguous lots shall be deemed to be a single lot for the purpose o f
determining, the bside lot lines". •

(b) The foregoing set back requirements m aybe waived, modified or allcred by
the architectural committee specified in Paragraph 18 hereof and the
architectural committee shall grant such waiver, modification or alteration
only in cases in which compliance with the ahove set back requirement? would

(c) Easements and rigjus-of-way are hereby reserved unto the DEVELOPER and
its successors and assigns for the construction, installation and maintcriancu
o f any and all utilities snch as electricity, gas lines, drains, sewers, roads,
water supply lines, telephone, cable TV or the like, necessaty of desirable for
the public health and welfare. Such easements aad rigMs-of-way shall be
confined to a five fbot wide width along the rear and side lot lines o f every lot
and along every street abiding the premises, unle. s otherwise designated on
the plat

(d) DEVELOPER hereby reserves the right to release, convoy, relinquish and
extinguish forever any easements, rights-of-wtiy or set backs wheLher
indicated on 2 plat or contained in these protective covenants, in
dreumstxnees where the release, abandonment, extinction ofsui-h easements,
rights-of-way or set backs are necessary f t r the full use aad ettfoyment o f two
or mere lots used as a single building site, with the approval of the
architectural committee.

(e) The release, abandonment and extinction o f such easements, rights-of-way or
set backs may be accomplished by recording ra the public records o f Taney
County, Missouri, a statement o f release, abandonment or extinction referring
to the block and lot numbers o f the lot effected at upon the filing o f such
statement, the easement, right*of-way or set back reserved by or in fiivor o f
DEVELOPER shad be forever extinguished.

(0 No water well, cesspool or septic tank shall be permitted on any lot and all
homes shall be connected to the ccntra! w ater and sewer system serving the
development.

(g) i 'o parking o f any type of vehicles shall be. permitted on any street in the
subdivision unless the same is approved by the architectural committee. The

vehicle on any street in the subdivision

3. No structure with an unfinished exterior shall be permitted to remain on any lot for
a period exceeding six (6) months and all construction on the structure shall be
completed within twafvc ( 12) months after commencement o f construction.

10. No animals, horses, birds or poultry shall be kept or maintained on any lot except
recognised household pets which may be kept thereon uot to excecd two in number
as pets for the pleasure and use of the occupants, but not for any commercial use or

acknowledged modifying or abolishing these restrictions and the same shall then be
recorded in the deed records o f Taney County, Missouri.

The T an ey C ounty P lanning D epartm ent provides a w ide variety of professional
com m u nity planning services to the citizens of T an ey County. B etw een on-going
d e ve lo p m e n t adm in istra tion duties and a variety o f special projects, the D epartm ent
rem ained e xcep tionally busy th ro ugho ut 2014. This A nnual R eport d o cu m e nts the
a cco m plishm ents o f the D epartm ent during 2014 and sets a course fo r continued
progress in 2015.

T an ey C ounty is a w o nderful m ix of both rural and rapidly grow ing urban land uses.
The T an ey C ounty P lanning C om m ission and the Board of A d ju stm e n t are hard-w orking

Regulations, the Taney C ounty Road Standards, the M aster Plan, the Floodplain M anagem ent
O rdinance and policies set by the C ounty C om m ission, the Planning C om m ission and the
Board of A djustm e nt. T he S tatutory A u th o rity for T an ey C ounty's form of Planning and Zoning
is based upon the provisions o f RSM o 64.800 - 64.900.

In 2014 the Planning D epartm ent received a total of tw elve (12) D ivision III
P erm it applications. O f the total num ber of D ivision III P erm it a p p lications
received e ight (8) w e re approved, tw o (2) w e re denied, one w a s found to be
e xe m p t (agricultural use) and one (1) w as initially tabled. In 2014 the num ber of
D ivision III a p p lications received by the Planning D epartm ent decreased by 54%
w hen com pared w ith the total num bers processed in 2013 (T w en ty-six (26)
D ivision III P erm it A p p lications w e re received in 2013). P lease note th a t a
com ple te listing o f the D ivision III Perm its fo r 2014 m ay be found in A p p e n d ix A.

❖ Division II Permits

In 2014 the Planning D epartm ent issued a total of fifty-eig ht (58) D ivision II
P erm its fo r the construction of com m ercial, industrial, institutional, duplex, m ulti­
fam ily, school and church structures. The num ber of Division II P erm its issued in
2014 increased by a pp ro xim ate ly 12% from the num ber of perm its that w ere
issued over the sam e tim e period in 2013 (fifty-tw o (52) Division II P erm its w ere
issued in 2013). Please note th a t a com plete listing o f the D ivision II P erm its for
2014 m ay be found in A p p e n d ix B.

❖ Division I Permits

In 2014 the P lanning D epartm ent issued a total of one hundred and seven ty
(170) D ivision I Perm its (with a single denial) fo r the construction of residential
structures, residential additions, accesso ry structures in excess of 100 square
fe e t in ground cover and the placem ent of m obile hom es. T he num ber of
D ivision I P erm its issued in 2014 decreased by app ro xim ate ly 2% from the
num ber that w e re issued in the sam e tim e period in 2013 (174 Division I Perm its
w ere issued in 2013). Please note that a com plete listing o f the Division I

❖ Plat Review

In 2014 the Planning D epartm ent processed a total o f fo rty-tw o (42) plat
applications. O f the forty-tw o (42) total applications, six (6) plats w ere final plats,
nineteen (19) w ere classified as replats and seventeen (17) w e re m inor
subdivision plats. T he year 2014 saw a slight decrease of a p p ro xim a te ly 5% in
the total num ber of plats processed over the am ount processed over the sam e
tim e fram e in 2013 (44 plat a p p lications w ere processed in 2013). P lease note
th a t a com ple te listing of Plats processed in 2014 m ay be found in A p p e n d ix E.

❖ On-Site Wastewater Permits

In 2014 there w ere a total of fifty-o n e (51) O n-S ite W a ste w a te r P erm its that were
issued. O f the fifty-one (51) total applications, tw enty (20) w e re fo r new basic
system s, seven (7) w ere fo r alternative system s, nine (9) w e re fo r STEP system ,
fourteen (14) w e re fo r tank repla cem ent and one (1) w as fo r a lagoon. Please
note that sixty-tw o (62) O n-S ite W a ste w a te r Perm its w ere issued in 2013, a
decrease o f app ro xim ate ly 18%. P lease note that a com plete listing of the O n­

❖ Water Quality Sampling

In 2014 the Lab orato ry D irector com pleted a total of three hundred and fo u r (304)
stream sam pling site counts, w hich w ere taken at specific locations upon lakes,
rivers and strea m s th ro u g h o u t T an ey County. In 2014 a total of seven ty-one (71)
potable drinking w a te r (ground w a te r w ells) sam ples w e re taken and tested. O f
the total seven ty-one (71) sam ple s th a t w e re tested, fifty-tw o (52) w ere found to
be sa tisfactory and nineteen (19) w ere found to be unsatisfactory. N um erous
com pla ints of sew er surfacing w e re in vestigated by S cott S tarre tt and M ike Cole
th ro u g h o u t the year. The W a te r Q uality Lab has the ability to perform fecal
coliform testing, allow ing fo r a d eterm inatio n to be m ade as to w h e th e r a health
hazard exists. In 2014 fo u r (4) fecal coliform tests w ere perform ed. P lease note
th a t a detailed listing of the stream sam pling site counts, potable drinking w a te r
(ground w a te r w ells) sam ples and fecal coliform tests fo r 2014 m ay be found in
A p p e n d ix G.

❖ Board of Adjustment Requests

In 2014 the P lanning D epartm ent processed a total o f nine (9) a p p lications for
appeal and varian ce requests. O f the nine (9) total applications, eight (8) w ere
varian ce requests and one (1) w as an appeal request. O f the eight (8) variance
requests heard, six (6) w ere approved and tw o (2) w ere tabled. The single

Floodplain Management

On A p ril 1, 2004 the T an ey C ounty C om m ission adopted a Floodplain
M anag em e nt O rdinance and Flood Insurance Rate M aps (FIR M ), ensuring that
all property ow ners w ithin the unincorporated area of T an ey C ounty are eligible
fo r flood insurance via the N ational Flood Insurance Program (NFIP). P er the
provisions of the Floodplain M anag em e nt O rdinance the Planning A d m in istra to r
is designated as the Floodplain A d m in istra to r for T an ey County.

In A p ril and M ay of 2011 tw o record flooding events ravaged areas of T an ey
C ounty. In 2011 the T an ey C ounty C om m ission m ade the decision to assist nine
(9) prope rty ow ners w h ose properties w ere su b sta n tia lly d a m a g e d (FE M A
defin es substantial dam age as dam ag e in excess of 50% of the m arke t value of
the structure) during these two flooding events, by participating in a F E M A flood
buyout via the Hazard M itigation G rant Program (H M G P). The H M G P is a
program only available to m unicipalities and county g ove rn m en ts allow ing fo r the
C ounty to apply on beh alf of these im pacted property ow ners. T he H M G P is a
Federal grant program that has paid fo r 75 % of all of the costs associated with
the flood buyout. T an ey C ounty also applied and received approval from the
M issouri D epartm ent of E conom ic D evelo pm e nt (M oD E D ) fo r a C om m unity
D evelo pm e nt Block G rant (C D B G ) w hich w as utilized to pay fo r the 25% required
non-F ederal m atch.

A fte r 3 1/2 years, T an ey C o unty has finally successfully closed out the FE M A
H M G P grant. The sta ff is hopeful that w e w ill be able to close out the M oD E D
C D BG in the com ing w eeks. T he final rem aining step in the H M G P and CD BG
processe s will be a required single audit o f each grant program .
