OFFICIAL MINUTES
APRIL 30, 2012, 11TH DAY OF
THE APRIL ADJOURN TERM

The County Commission met in the Commission Hearing Room at 8:31 a.m. with Ron
Houseman and Danny Strahan present and Jim Strafuss absent. The following proceedings were
had and made a matter of record:

Commissioner Strafuss entered the meeting at 8:38 a.m.

PRELIMINARY STUDY

The County Commission met to review previous meeting minutes and accounts payable.

PUBLIC COMMENT

There was no public comment.

CALL TO ORDER

Presiding Commissioner Houseman called the April 30, 2012 meeting to order at 9:00 a.m.

PRAYER

Treasurer Helen Soutee led the prayer.

PLEDGE OF ALLEGIANCE

Commissioner Strahan led the Pledge of Allegiance.

Commissioner Houseman recognized Tyler Franke with Branson Tri-Lakes Daily News as he
was relocating, and thanked him for the service he had provided.

PREVIOUS MEETING MINUTES

Commissioner Strafuss moved to approve previous meeting minutes dated April 19 and 23, 2012
with correction and changes. Commissioner Strahan seconded the motion. The motion passed
by vote: Houseman (aye), Strahan (aye) and Strafuss (aye).

ACCOUNTS PAYABLE/JOURNAL ENTRIES/TRANSFERS

Commissioner Strafuss moved to approve accounts payable as follows: Commissioner Strahan
seconded the motion for discussion. Commissioner Strahan asked about the check being held.
Commissioner Strafuss requested Mr. Cottey review the issue one final time. Discussion ensued.
The check would be added to next week’s accounts payable for approval. The motion passed by
vote: Houseman (aye), Strahan (aye) and Strafuss (aye).
ANNUAL SALES TAX/USE TAX REPORTING

Commissioner Strafuss moved to approve the request for information audit of local sales and use
tax records. Commissioner Strahan seconded the motion. The motion passed by vote:
Houseman (aye), Strahan (aye) and Strafuss (aye).

SUPREME COURT DECISION/SALES TAX

Commissioner Houseman stated the Supreme Court had made a recent decision, which would
impact the County to our detriment. A class action suit was pending, which would impact the
County even more.

Commissioner Strafuss explained the Supreme Court case of Street versus the Department of
Revenue in which Mr. Street paid his boat sales tax under protest as he purchased it out of state.
Commissioner Strafuss explained the collection of sales tax at the city and county level. An
estimated sales tax loss amount on used vehicles would be between $225,000 and $250,000, until
it was corrected. Commissioner Strafuss stated the second phase of the process if deemed
unconstitutional this year, would it be unconstitutional for the past 5 years. Commissioner
Houseman questioned if a use tax proposal needed to be presented to the voters. Commissioner
Strahan said this was one of many things that have lessened revenue since hard economic times.

Tyler Franke asked if cities would have to apply the tax in the same manner as the county.
Commissioner Houseman said he thought a city would have to pass their use tax.

BID PROCEDURE – AGGREGATE ROAD MATERIALS

Purchasing Director Ron Erickson stated as he had worked with Mr. Haes and the addendums of
the bid. As Mr. Haes was not available, Mr. Erickson’s intention was to request a certain time be
set after Mr. Haes and Mr. Erickson had time to discuss details thereof. Bids were for concrete,
asphalt, Chip and Seal material and aggregate, all inclusive.

BID PROCEDURE – AGGREGATE ROAD MATERIALS

Purchasing Director Ron Erickson went before the Commission to open 201204-177 bids, for
aggregate road materials. As of this morning nine sealed responses were received. He would
check to ensure bid completion. The first submission was from American Materials of Ozark.
The second submission was from John Stallcup. The third submission was from Costal Energy
of Willow Springs. The fourth submission was from Cleaver Stone of Mt. Vernon. The fifth
submission was from APEC Central of Fayetteville, Arkansas. The sixth submission was from
Bevin’s Asphalt of Mt. Vernon, which did not include a signature on the bid page. The seventh
submission was from Mansfield Lime & Stone Quarry of Kirbyville. The eighth submission was
from American Concrete Products of Ozark. The ninth submission was from Table Rock
Asphalt.

Commissioner Houseman reviewed the list of specifications. Mr. Erickson read the bid notice
and discussion ensued. Commissioner Houseman asked how much time would be needed to
make a recommendation. Mr. Erickson said he should be ready by Thursday. The
recommendation would be posted for next Monday.

EXECUTIVE SESSION – LITIGATION & CONTRACTS PER SECTION 610.021(1) (12)

Commissioner Strafuss moved to go into Executive Session pursuant to RSMo 610.021(1) and
(12). Commissioner Strahan seconded the motion. The motion passed by roll call vote:
Houseman (aye), Strahan (aye), and Strafuss (aye).

Commissioner Houseman exited the meeting at 10:00 a.m.

Commissioner Strafuss moved to go out of Executive Session. Commissioner Strahan seconded
the motion. The motion passed by roll call vote: Houseman (absent), Strahan (aye), and Strafuss
(aye).

RECORDS DESTRUCTION

Deputy Clerk Cristy Smith went before the Commission to discuss record destruction.
Commissioner Strafuss asked if any of the records would be requested for the Audit. Discussion
ensued. Commissioner Strafuss moved to approve the records disposition, omitting items 338
and 339. Commissioner Strahan seconded the motion. The motion passed by vote: Houseman
(absent), Strahan (aye) and Strafuss (aye).
AGENDA REQUESTS REVIEW

Nikki Lawrence went before the Commission to review agenda requests.
