OFFICIAL MINUTES
JUNE 30, 2011, 33rd DAY OF
THE APRIL ADJOURNED TERM

The County Commission met in the Commissioner’s Hearing Room at 8:35 am with Ron
Houseman, Jim Strafuss and Danny Strahan present. The following proceedings were had and
made a matter of record:

AGENDA REQUESTS REVIEW

The Commission reviewed the agenda requests with Nikki.

John Soutee reported to the Commission regarding the Lookout Acres contract. Sewer District
attorney David Fielder reviewed the contract, and had contacted Mr. Cottey, County Counsel, to
determine how to proceed. It was requested that the contract with Victor Rosetta be reviewed by
the Commission.

RECORDS DESTRUCTION

A records destruction list was presented to the Commission. Commissioner Houseman stated on
record that destruction can be done by all county officials; but some should not be destroyed as
they may have historical value. Historical value could be determined with a review by the
Historical Society prior to destruction. The presented destruction list follows:

TRANSFER STATION

The Commission discussed flood related houses that needed to be destroyed.

WELLNESS CENTER UPDATE

Nikki addressed the Commission to show appreciation from the Wellness Committee for
employees utilizing the wellness center. She explained how they could go to Melissa Duckworth
to allow their employee ID badges to gain access. There were 10 to 20 employees using the
facility daily. A budget line had not yet been designated. There was currently money in the
miscellaneous fund. Equipment stored in the judicial facility needed to be sold. There would be
a sale at an undetermined date after future discussion.

County Auditor Rick Findley stated that is they County had built a budget line, statutes would
not allow funds to be kept at year end. The Commission directed Rick to budget the dollar
amount in GCR under other expenses, titled Wellness Center, for expenditures.

Nikki asked if they could have educational classes during the day. The Commission said during
lunch hours that would be appropriate, and that if the presentation reduced insurance rates, then
it could be at anytime.

SEWER BOARD FOLLOW UP DISCUSSION

John Soutee, Administrator for Taney County Regional Sewer District, addressed the
Commission. Since June 13th, the Sewer Board obtained the legal counsel of David Fielder at
the County Attorney’s suggestion. David Fielder had been informed of Pat Keck’s two
declaratory judgments: 1) the Sewer District was a political subdivision; and 2) usage and
utilization of the sales tax fund. He has also been informed of the objective of separation of the
TCRSD from the County Commission relationship and what was trying to be achieved.

Rates, staffing options and available structures for relocation were being reviewed. They would
be requesting direction from the Board of Trustees.

Issues had been discussed with Jim Berry of the County Health Department and the State DNR.
Statutes provide for the County Health Department to pick up those services.

90% of John and Suzie’s job duties were involved in capital improvement sales tax projects.
Questions regarding salaries being supplemented out of the sales tax were asked. Properties and
locations were discussed. There were concerns expressed on the insurance coverage of the
employees. The Commission directed John to call Tim Connell and then One Beacon, if
necessary.

David Fielder addressed the Commission. He had previously worked with Pat Keck and Frank
Cottey. David was trying to resolve transition issues as soon as possible.

Commissioner Houseman read an email that suggested an intergovernmental agreement for
consideration between the Sewer Board of Directors and the County of Taney. Commissioner
Houseman stated they were amenable to all options.

William Cummings, Chairman of the Board of the Taney County Regional Sewer District shared
that he was a volunteer, not an elected official, and he felt the people of Taney County and the
citizens needed to come first.

HAZARD MITIGATION WORK SESSION

Bob Atchley introduced Jim Lawson as the Director of Branson’s Planning Department. Jim
was there to answer any questions regarding the City of Branson’s approach to the Hazard
Mitigation Plan.

Bob presented the Commission with a presentation of information learned from FEMA/SEMA.
Points of interest were: Substantial and not-substantial damage assessments, FEMA voluntary
flood buyout program, Hazard Mitigation Grant Program, eligible project costs, Benefit-Cost
Analysis, non-federal match, Repetitive Flood Claims Grant Program, and Severe Repetitive
Loss Properties.

Commissioner Houseman asked Jim Lawson to report on Branson’s experience of the Hazard
Mitigation process. Mr. Lawson spoke to the Commission about different scenarios and
situations he had encountered.

The Commission asked Bob to further research Community Development Block Grants.

Commissioner Strafuss moved to authorize Taney County to facilitate, with the Purchasing
Department Personnel, any State or Federal grant programs that could provide funds to assist in
the purchase of any voluntarily submitted property, affected by the floods of 2011, with the
caveat that any matching funds that were necessary to complete any application would be
provided by the property owner, or from any non-federal monies. Commissioner Strahan
seconded the motion. The motion passed by vote: Houseman (aye), Strahan (aye) and Strafuss
(aye).
