OFFICIAL MINUTES
September 30, 2009, 39th DAY OF
THE JULY ADJOURN TERM
The County Commission met in The Commissioner’s Office at 8:23 AM with
Commissioners Chuck Pennel and Danny Strahan present, and Jim Strafuss present via
teleconference. Bob Paulson, Frank Preston, Nikki Lawrence and Cristy Smith were also
present. The following proceedings were had and made a matter of record:
CALL TO ORDER

EMERGENCY MEETING
The County Commission convened and announced that yesterday afternoon a matter that
really needed to be addressed immediately had arisen. An offer had been made by the
Missouri Highway and Transportation Commission regarding the conveyance of its
Hollister Maintenance Facility/Mt. Branson Barn to Taney County. Commissioner
Strafuss learned that MoDOT may be having second thoughts, and that Taney County
needed to accept the offer quickly to avoid it being withdrawn. Since the matter needed
to be taken up immediately, the normal 24 hour notice was not given for the meeting.
Commissioner Strafuss stated that he asked the County Counselor to prepare a letter
accepting the offer made by the Missouri Highway and Transportation Commission. The
Commissioners reviewed the letter and its exhibits, including the Road Relinquishment
Agreement. Commissioner Strafuss then moved that the Taney County Commission
accept the offer by signing and sending the letter prepared by the County Counselor. The
letter set forth the terms of the offer calling for the Missouri Highway and Transportation
Commission to convey the Mount Branson Barn to Taney County in return for Taney
County agreeing to take and maintain four +/- miles of BB Highway and paying
$200,000.00. Commissioner Strahan seconded the motion. The motion passed by vote:
Pennel (aye), Strahan (aye), and Strafuss (aye).
Commissioners explained further details of the agreement contained in the Road
Relinquishment Agreement which the Commissioners included with the acceptance
letter. The Road Relinquishment Agreement set forth MoDOT’s commitment to
resurface portions of BB Highway before relinquishment to Taney County.
Presiding Commissioner Pennel declared a recess.

9:00 AM
The County Commission reconvened in The Commissioner’s Office at 9:00 AM with
Commissioners Chuck Pennel and Danny Strahan present, and Jim Strafuss absent. Bob
Paulson, Frank Preston, Donna Neeley, Rick Findley and Cristy Smith were also present.
