OFFICIAL MINUTES
April 13, 2009 5th DAY OF
THE APRIL ADJOURN TERM
The County Commission met in the Commissioners Hearing Room at 9:00 AM with
Chuck Pennel, Danny Strahan, and Jim Strafuss present. The following proceedings were
had and made a matter of record.
Prayer led by Chuck Pennel.
APPROVAL OF MINUTES
Commissioner Strafuss moved to approve the minutes for 4/6, 4/7 and 4/8. Commissioner
Pennel seconded the motion. Motion passed by vote: Pennel (aye), Strahan (aye), and
Strafuss (aye).
ACCOUNTS PAYABLE
Commissioner DS moved to approve the following Accounts payable:
Checks: 309290 – 309302, 309389 – 309474
Voided: 309303 - 309388
Warrants: 4999 - 5000
Commissioner Pennel seconded the motion. . Motion passed by vote: Pennel (aye),
Strahan (aye), and Strafuss (aye).
PUBLIC COMMENT
Ron Herschend commented on equal opportunity employer notification missing from
newspaper ad.
Bob Schanz commented on the east/west corridor article in the Branson Daily News.
Jeff Knight addressed the Commission about the appliance cleanup at the transfer station.
The Commission instructed Mr. Knight that Tressa Luttrell was writing up the specs for a
bid since there is more than one person interested in doing that business and that she will
send the bid specifications to him when finished.
Friday and Saturday April 17 & 18 are the spring trash pickup in the county at Kissee
Mills and at the Transfer Station at Branson.
POWELL ROAD VACATION
Commissioner Strafuss moved to table Powell road vacation. Commissioner Strahan
seconded the motion. Motion passed by vote: Pennel (aye), Strahan (aye), and Strafuss
(aye).
MICKEY GILLEY BENEFIT
Mickey Gilley presented a check for animal food at the animal control shelter in the
amount of $2,501.33 as a result of a 3 day benefit show. Also received 793 bags of dog
food plus cat food and dog bones. The Commission expressed their thanks to Mr. Gilley
for his success in this effort.
STATE TAX COMMISSION VERSUS TANEY COUNTY
Commissioner Pennel discussed status of the lawsuit and status of the settlement
agreement.
BID AWARD - NEWSPAPER SERVICE
Commission Pennel moved to approve Taney County Times as primary and Branson
Daily News as secondary for legal publications and want ads. Commissioner Strafuss
seconded the motion. The motion passed by vote: Pennel (aye), Strahan (aye), and
Strafuss (aye).
JAMES STRAHAN –TAXATION AND MISREPRESENTATION
James Strahan commented on the inaccuracy of the headline and article in the paper
concerning the assessor’s budget.
Commissioner Pennel commented on his position concerning the lawsuit and settlement
agreement with the State Tax Commission.
Dorothy Johnston commented on speaking with the State Tax Commission about the
assessor’s office.
Commissioner Strahan commented on news media coverage.
Ron Herschend commented that he thought James Strahan has done a good job of
running his office on a reasonable budget.
Sam Clanton commented on the existence of editors that write headlines and that the
reporters are just doing their job.
Commissioner Pennel commented that he appreciates the Radio and Newspapers and the
fact that we have a free press.
Presiding Commissioner Pennel declared a recess.

Nikki reviewed open items that she needed to address with the commission.
BOB PAULSON – WORK SESSION WITH THE COMMISSION
Commissioner Strafuss moved to go into executive session for litigation and/or personnel
pursuant to RSMo 610.021. (1) & (3). Commissioner Pennel seconded the motion. . The
motion passed by vote: Pennel (aye), Strahan (aye), and Strafuss (aye).

Bill Ray Foster
Branson Meadows Taxes
County Collector Sheila Wyatt brought a tax issue before the commission. Jim Strafuss
made a motion to wave fees and penalties pursuant to 52.240 for 2007 and 2008 for Billy
Ray Foster property number 8-9-30-0-0-63.000 due to a clerical error. Danny Strahan
seconded the motion. Motion passed by roll call vote: Pennel (aye), Strafuss (aye), and
Strahan (aye).
EXECUTIVE SESSION
Jim Strafuss made a motion to go into Executive Session for Litigation and Personnel
issue. Motion seconded by Chuck Pennel. Motion passed by roll call vote: Pennel (aye),
Strafuss (aye), and Strahan (aye).

Jim Strafuss made a motion to go out of Executive Session at 2:07 pm pursuant to RSMo
610.021. (1) & (3). Danny Strahan seconded the motion. Motion passed by roll call vote:
Pennel (aye), Strafuss (aye), and Strahan (aye).
RECOVERY ACT RURAL LAW ENFORECEMENT GRANT
Gary Morgan presented grant information to fund a county employee to work in the
information systems department for two year. No motions made.
EXECUTIVE SESSION
Jim Strafuss made a motion to go into Executive Session for personnel and litigation at
2:24 p.m. in the Commission Conference room. Members present Pennel, Strafuss, and
Strahan. Other persons present Nikki Lawrence. Chuck Pennel seconded the motion.
Motion passed by roll call vote: Pennel (aye), Strafuss (aye), Strahan (aye). No motions
made. Discussed State Tax Commission litigation.
Jim Strafuss made a motion to go out of Executive Session at 2:57p.m.. Danny Strahan
seconded the motion. Motion passed by roll call vote: Pennel (aye), Strafuss (aye),
Strahan (aye).
RECONVENED
Reconvened regular session of the commission at 2:48p.m.in the Commission conference
Room. Members present Pennel, Strafuss, and Strahan.
BB/COON CREEK CUT-OFF EASEMENT
Jim Strafuss made a motion to table the Coon Creek issue. Chuck Pennel seconded the
motion. Motion passed by vote: Pennel (aye), Strafuss (aye), Strahan (aye).
