OFFICIAL MINUTES
MARCH 30, 2009, 41st DAY OF
THE JANUARY ADJOURN TERM
The County Commission met in the Commissioners Hearing Room at 9:00 AM with
Chuck Pennel Danny Strahan and Jim Strafuss present. The following proceedings were
had and made a matter of record.
Prayer led by Rick Findley.
APPROVAL OF MINUTES
Commissioner Pennel moved to approve the minutes for March 23, and March 25, 2009.
Commissioner Strafuss seconded the motion. Motion passed by vote: Pennel (aye),
Strahan (aye), and Strafuss (aye).
ACCOUNTS PAYABLE
Commissioner Strahan moved to approve the following Accounts payable:
Checks: 309066 – 309182
Warrants: 4990
Commissioner Strafuss seconded the motion. . Motion passed by vote: Pennel (aye),
Strahan (aye), and Strafuss (aye).
Because of a bill from Wright County for prisoner boarding, Commissioner Pennel
discussed the cost we have to pay another county ($45/night) above what the state pays
($22/night) leaving a net cost of ($23/night).
PUBLIC COMMENT
Mike Gurke discussed Barton Road and requested that the county complete the project
since it has been started.
Ron Herschend spoke on upcoming vote on sales tax issue and concern about cost
estimates and provision for cost overrun prevention. Mr. Herschend also commented on
rumors concerning animal control and asked that the Commissions statement be very
public when made.
ROAD PETITIONS
Kiiedon Court and Kiier Court road petition was read by Commissioner Pennel.
Commissioner Pennel moved to table this petition for further consideration.
Commissioner Strafuss seconded the motion. Motion passed by vote: Pennel (aye),
Strahan (aye), and Strafuss (aye).
BLUE RIDGE ROAD
Mike Burdine was before the Commission on the matter of the Blue Ridge Road petition.
Commissioner Pennel read part of the petition into the record.
Commissioner Strahan moved to table the request pending the petition being re-written
for the road only up to address 975 and Road and Bridge revising cost estimates to that
point. Commissioner Strafuss seconded the motion. Motion passed by vote: Pennel (aye),
Strahan (aye), and Strafuss (aye).
NACO PHARMACEUTICAL PROGRAM
Commissioner Strahan moved to table for a week. Commissioner Pennel seconded the
motion. Motion passed by vote: For - Pennel (aye), Strahan (aye), and opposed Strafuss
(nay).
POWELL ROAD
Commissioner Pennel moved to table the consideration on Powell Road until 1:00 PM.
Commissioner Strafuss seconded the motion. Motion passed by vote: Pennel (aye),
Strahan (aye), and Strafuss (aye).
4TH COURTROOM JUDGES BENCH
Commissioner Pennel moved to table the question until 1:00 PM.
Commissioner Strafuss seconded the motion. Motion passed by vote: Pennel (aye),
Strahan (aye), and Strafuss (aye).
Presiding Commissioner Pennel declared a recess.

NIKKI LAWRENCE – WORK SESSION WITH THE COMMISSION
Nikki reviewed current items and scheduling with the Commission.
BOB PAULSON – WORK SESSION WITH COMMISSION
Bob reviewed his top 10 list of tasks in progress, with the Commission.
POSTAGE MACHINE – GARY MORGAN
Gary Morgan presented some pricing on a mailing machine for the judicial center and
also a proposal for a mail department as an alternative.
NUISANCE ORDINANCE
Commissioner Pennel recommended that for the few nuisance ordinances complaints that
are coming in at present, he would handle the initial reports to be presented to the
Commission for action.
OZARK BEACH CHANGE ORDER
Commissioner Pennel moved to approve a change order No. 2 on the Ozark Beach
Project Job No. 06-1985 for $112,631.25 with the exception that the Commission be
notified when the amount reaches $50,000. Commissioner Strahan seconded the motion.
Motion passed by vote: Pennel (aye), Strahan (aye), and Strafuss (aye).
The Commission directed John Soutee to have Road and Bridge to take care of Mrs.
Marsh’s property on Combs Street by using a rock rake and adding some top soil and to
shoot some grades to see if we have a fall going toward the county ditch near Mr.
Childress’s and Mr. Brink’s property.
Presiding Commissioner Pennel declared a recess.

RECONVENE
The meeting was reconvened at 1:25 P.M. in the commission conference room with the
following members present: Chuck Pennel, Jim Strafuss, and Danny Strahan.
Maintenance Update
Change Order for Judicial Center
Tressa Luttrell presented a change order #11A-006 for the Judicial Center. Tressa stated
that the County will be reimbursed by HMN for the change. Jim Strafuss made a motion
to approve the change order # 11A-006 for 11,793.75. Chuck Pennel seconded the
motion. Motion passed by vote: Pennel (aye), Strafuss (aye), and Strahan (aye).
Court Room #4
Commission reviewed bids for Court Room #4. Jim Strafuss made a motion to accept the
bid from Wyatt’s Cabinets for Court Room #4, contingent upon Brenda Neal’s approval.
Chuck Pennel seconded. Motion passed by vote: Pennel (aye), Strafuss (aye), and Strahan
(aye).
Scrap Metal Bid
Commission directed Tressa to bid the scrap metal service at the transfer station.
Lisa Owen’s wage
Commission discussed correcting Lisa Owen’s wage.
Executive Session
Danny Strahan made a motion to go into executive session pursuant to 610.021.3
personnel & litigation. Chuck Pennel seconded the motion. Pennel (aye), Strafuss (aye),
Strahan (aye). The Commission discussed Animal Shelter and Cross Creek Issue.
Jim Strafuss made a motion to go out of Executive Session. Chuck Pennel seconded the
motion. . Motion passed by vote: Pennel (aye), Strafuss (aye), and Strahan (aye).
Recessed at 3:12pm
