OFFICIAL MINUTES

MARCH 13, 2009, 36th DAY OF
THE JANUARY ADJOURN TERM

The County Commission met in the Commissioners Conference Room at 9:10 a.m. with
Chuck Pennel, Danny Strahan, and Jim Strafuss present. The following proceedings were
had and made a matter of record:

Commissioner Strafuss moved to go to into executive session pursuant to RSMo
610.021.17. Commissioner Strahan seconded the motion. The motion passed by roll call
vote: Pennel (aye), Strahan (aye), and Strafuss (aye).

Commissioner Strafuss moved to go out of Executive Session. Commissioner Strahan
seconded the motion. . The motion passed by roll call vote: Pennel (aye), Strahan (aye),
and Strafuss (aye).

OUT OF EXECUTIVE SESSION

CLEVENGER COVE

Commissioner Pennel moved to approve acceptance of the 8 easements on Clevenger
Cove Road as prepared by the road & bridge department. Commissioner Strafuss
seconded the motion. The motion passed by vote: Pennel (aye), Strahan (aye), and
Strafuss (aye).

DAM SITE SUB-DIVISION

Commissioner Strahan moved to deny assistance to the Dam Site sub division in order to
not set a precedent. Commissioner Pennel seconded the motion. The motion passed by
roll call vote: Pennel (aye), Strahan (aye), and Strafuss (aye).

The Commissioner directed John Soutee to notify the DNR of this decision.

Commissioner Pennel moved that the county is OK with the City of Branson using a
mechanism that if properties sell, the new owners would be liable to build to city code
and sign voluntary annexation and (2) the county would be against trying to obtain
reimbursement from new developers hooking onto the sewer.
Died for lack of a second.

The Commission asked John Soutee to contact Larry Van Gilder at the City of Branson
about the county’s position as follows: The County is not in favor of recovering fees for
the cost of the project from property owners. The County is not in favor of forcing
present owners into annexation now. The County is also in favor of the next property
owner having voluntary annexation.

The Commission directed Shawn McKinley and Tim Gilzow to talk with Brenda Neal
and others in the Judicial center about their postage machine needs and report back to the
Commission next week on those needs and recommendations and pricing on postage
machines.

Commissioner Strafuss moved to go into Executive Session pursuant to 610.021 (1) &
(3). Commissioner Pennel seconded the motion. The motion passed by vote: Pennel
(aye), Strahan (aye), and Strafuss (aye).
